By accessing, registering for, or using UMC RIDES, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and any applicable policies referenced in them.
If you do not agree with these Terms, please do not access or use UMC RIDES.
UMC RIDES reserves the right to update these Terms from time to time. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
2. Description of Service
UMC RIDES is a motorcycle ride-hailing platform that connects passengers with motorcycle riders/drivers through its website and related services.
The platform allows users to request motorcycle rides, view available ride information, communicate with drivers where applicable, and receive transportation services.
UMC RIDES may facilitate the connection between passengers and drivers but does not guarantee that a ride will always be available or that a particular driver will accept a ride request.
3. User Registration and Obligations
To use certain features of UMC RIDES, you may be required to provide accurate and complete information.
You agree to:
- Provide truthful, accurate, current, and complete information.
- Keep your account information secure and confidential.
- Not create an account using another person's identity or information.
- Not allow unauthorized persons to use your account.
- Immediately notify UMC RIDES if you believe your account has been compromised.
- Use the Service only for lawful purposes.
You are responsible for all activity carried out through your account.
4. Passenger Responsibilities
Passengers using UMC RIDES agree to behave respectfully and responsibly toward drivers and other users.
Passengers must not:
- Engage in abusive, threatening, violent, or discriminatory behavior.
- Damage or intentionally misuse a motorcycle.
- Carry prohibited or unlawful items.
- Provide false information when requesting a ride.
- Attempt to avoid or interfere with applicable ride charges.
- Use the Service for any unlawful activity.
Passengers are expected to follow reasonable safety instructions provided by the driver and UMC RIDES.
5. Driver Responsibilities
Drivers using UMC RIDES are responsible for operating their motorcycles safely and in accordance with applicable laws and regulations.
Drivers are expected to:
- Maintain appropriate and safe riding practices.
- Treat passengers respectfully and professionally.
- Provide accurate information to UMC RIDES.
- Maintain any legally required documentation, permits, insurance, and motorcycle requirements applicable to their activities.
- Never operate a motorcycle while impaired by alcohol, drugs, or any substance that may affect safe riding.
- Follow applicable road and traffic regulations.
UMC RIDES may take action against drivers who violate these Terms or applicable safety requirements.
6. Rides, Availability, and Cancellations
Ride availability may vary depending on location, time, driver availability, traffic, weather, and other circumstances.
A ride request does not necessarily guarantee that a driver will accept the request.
Passengers or drivers may cancel a ride where permitted by the Service. UMC RIDES may apply cancellation fees or other applicable charges where these are clearly communicated to the user.
UMC RIDES may also cancel, suspend, or prevent a ride when it reasonably believes that doing so is necessary for safety, security, legal compliance, or proper operation of the Service.
7. Fares and Payments
The fare for a ride may depend on factors such as distance, route, time, demand, location, or other applicable pricing factors.
Before or during a ride, UMC RIDES may provide users with an estimated or applicable fare where the Service supports such functionality.
Users agree to pay all applicable charges associated with rides they take through UMC RIDES.
Payment methods and payment processing options may vary. Where third-party payment providers are used, their own terms and policies may also apply.
UMC RIDES reserves the right to correct pricing or payment errors and to take reasonable steps to recover unpaid amounts.
8. Safety
Your safety is important to UMC RIDES.
Users should follow applicable traffic and safety requirements and use reasonable judgment when using the Service.
Passengers should use appropriate protective equipment and follow applicable motorcycle safety requirements.
If you experience an emergency during a ride, contact the appropriate emergency services or authorities immediately. UMC RIDES may provide additional safety or support assistance where available.
UMC RIDES does not guarantee that accidents, injuries, theft, delays, or other incidents will never occur while using the Service.
9. Prohibited Activities
You may not use UMC RIDES to:
- Commit or facilitate illegal activities.
- Harass, threaten, abuse, or harm another person.
- Fraudulently obtain rides or services.
- Interfere with or attempt to disrupt the Service.
- Access or attempt to access another user's account.
- Introduce malicious software or other harmful technology.
- Reverse engineer or improperly copy the platform or its systems.
- Use the Service in a manner that could damage UMC RIDES, its users, drivers, or partners.
UMC RIDES may suspend or terminate accounts involved in prohibited activities.
10. Lost Property
If you believe you have left an item on a motorcycle after a ride, you should contact UMC RIDES as soon as reasonably possible through the available support channels.
UMC RIDES may assist passengers and drivers in attempting to recover lost property, but cannot guarantee that a lost item will be recovered.
Users are responsible for their personal belongings and should check the motorcycle before completing their ride.
11. Limitation of Liability
To the extent permitted by applicable law, UMC RIDES shall not be responsible for losses or damages arising from circumstances beyond its reasonable control, including accidents, traffic conditions, weather, delays, communication failures, third-party services, or actions of users or drivers.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
Users acknowledge that transportation involves inherent risks and agree to use reasonable care while using the Service.
12. Suspension and Termination
UMC RIDES may suspend, restrict, or terminate a user's access to the Service if the user:
- Violates these Terms.
- Provides false or misleading information.
- Engages in fraudulent, abusive, unsafe, or unlawful conduct.
- Creates a risk to other users, drivers, or UMC RIDES.
- Fails to pay applicable charges.
UMC RIDES may also suspend or discontinue parts of the Service when necessary for operational, technical, legal, or security reasons.
13. Intellectual Property
All content and materials associated with UMC RIDES, including its name, logo, branding, website design, software, graphics, text, and other original materials, are owned by or licensed to UMC RIDES unless otherwise stated.
You may not copy, reproduce, modify, distribute, sell, or commercially exploit UMC RIDES intellectual property without prior authorization.
14. Privacy and Personal Information
UMC RIDES may collect and process information necessary to provide and improve its services, including information provided during registration, ride requests, payments, communications, and customer support.
UMC RIDES will handle personal information in accordance with its applicable Privacy Policy and applicable data-protection requirements.
By using the Service, you acknowledge that certain information may be required to facilitate rides, improve safety, process payments, provide customer support, and operate the platform.
15. Third-Party Services
UMC RIDES may rely on third-party services, including payment providers, mapping services, communication services, hosting providers, or other technology providers.
UMC RIDES is not responsible for interruptions or failures caused solely by third-party services, although we may take reasonable steps to address issues affecting the Service.
16. Modifications to the Service
UMC RIDES reserves the right to modify, improve, suspend, or discontinue the Service, or any part of it, temporarily or permanently, with or without notice where permitted by applicable law.
We may also introduce new features, services, pricing structures, or requirements from time to time.
